Asbestos exposure as a schoolboy caused mesothelioma death at age 53

In November 2019 the High Court of Justice in London heard an asbestos compensation case brought against Liverpool City Council. David Trimm, a former painter and decorator, sadly passed away at the age of 53 due to the asbestos cancer, mesothelioma. The claim was brought by David’s widow, Georgia Trimm, and was valued at around £500,000.

Exposure to asbestos lagging

It is believed David was exposed to asbestos when he attended Highfield Comprehensive School, now Broadgreen International School. David would often go under the stage at school, being sent there by teachers to get benches and props for performances. The moving of equipment would unsettle dust created by the asbestos lagging on pipework under the stage, causing him to be exposed to this. David was further exposed to asbestos when he and his friends would bunk off classes and go under the stage, resting their feet on the pipework which was lagged with asbestos. The asbestos lagging would release dust into the air which he would breathe in and which would ultimately settle on his uniform. It was estimated that he would spent up to ten hours a week under the stage.

Defendant denied liability

The case was brought against Liverpool City Council who would have had authority over the school at the time that David attended. They denied liability, meaning they refused to say they were at fault, however in Court they agreed a confidential payout to settle the claim.

Mesothelioma symptoms started in 2011

David first developed symptoms of mesothelioma in 2011 and suffered from increasingly severe pain as his condition developed. It is thought that, had it not been for the mesothelioma, he would have lived into his 80's.

Settlement not disclosed

It is not known how much the claim settled for as the settlement figure has not been disclosed. Whilst no amount of money can make up for the loss of a spouse, particularly at such a young age, this successful case has allowed Mrs Trimm and her family to hold the Council to account for their negligence.
