
Exposure to Asbestos:
We obtained a detailed witness statement to support Mr B's claim for asbestos. This statement showed that he was exposed to significant amounts of harmful asbestos dust during the course of his employment with Anchor Insulating Co Limited between approximately 1955 and 1957. He was employed as an insulation stripper for the company and had to strip, mix and apply asbestos lagging regularly. Sadly, he was heavily exposed to asbestos dust. Furthermore, during the 1960/61 tax year for approximately 12 months, Mr B gained employment working as a labourer with the Central Electricity Generating Board (now known as E-On PLC), working at their Deptford Power Station. The power station was filled with asbestos dust from lagging which covered pipes and boilers. Mr B regularly had to sweep up the mess left behind by other workers who had stripped the lagging. On other occasions he would assist workers in removing asbestos lagging. He was also exposed to significant quantities of asbestos dust during the course of this period of employment at the power station. It was alleged that Mr B suffered negligent exposure to airborne asbestos dust which led to him suffering with debilitating asbestos related pleural disease.The case:
Helpfully, the Defendants admitted to having negligently exposed Mr B to asbestos early in the case. We also obtained a medical report which confirmed his pleural thickening diagnosis. Unfortunately, Mr B had developed a 10% respiratory disability as a result of his exposure to asbestos. Mr B is also at risk of developing other asbestos-related conditions in the future. We settled the claim on a provisional damages basis, leaving the door open for Mr B to claim further asbestos compensation if he develops:- mesothelioma;
- asbestos related lung cancer;
- asbestosis or;
- a deterioration in his diffuse pleural thickening.
